Law enforcement agencies are turning to the Department of Defense, more and more, for their tactical policing needs, requesting such items as Mine Resistant Ambush Protection (MRAP) vehicles, surplus Humvees, rifles, and other assorted military-grade hardware. While some can be used in special operations, such as protecting officers from active shooters, or gaining entry into heavily fortified buildings, the sheer audacity of one Oklahoma Sheriff goes far beyond this.

canacountysheriff_mrap2Sheriff Randall Edwards, of the Canadian County Sheriff’s Office, located on the western edge of Oklahoma City, has failed miserably in his attempt to soften the image of these war machines by stenciling, “Protecting Your Constitutional Rights“, on the sides of his new MRAP and Humvee.

How does a 50,000 lb. vehicle, capable of shielding occupants from rocket propelled grenades and AK-47 fire, protect American Rights?

Does this vehicle serve to protect protesters exercising their First Amendment right? Will the Sheriff deploy this armored beast to aide in citizens wishing to vote, or perhaps, to shelter his fellow Oklahomans who decide to use their Second Amendment right?...

Yesterday, there was a wall of Tesla patents in the lobby of our Palo Alto headquarters. That is no longer the case. They have been removed, in the spirit of the open source movement, for the advancement of electric vehicle technology.

Tesla Motors was created to accelerate the advent of sustainable transport. If we clear a path to the creation of compelling electric vehicles, but then lay intellectual property landmines behind us to inhibit others, we are acting in a manner contrary to that goal. Tesla will not initiate patent lawsuits against anyone who, in good faith, wants to use our technology.

When I started out with my first company, Zip2, I thought patents were a good thing and worked hard to obtain them. And maybe they were good long ago, but too often these days they serve merely to stifle progress, entrench the positions of giant corporations and enrich those in the legal profession, rather than the actual inventors. After Zip2, when I realized that receiving a patent really just meant that you bought a lottery ticket to a lawsuit, I avoided them whenever possible....

The Bureau of Land Management, whose director was Sen. Harry Reid’s (D-Nev.) former senior adviser, has purged documents from its web site stating that the agency wants Nevada rancher Cliven Bundy’s cattle off of the land his family has worked for over 140 years in order to make way for solar panel power stations.

Deleted from BLM.gov, but reposted for posterity by the Free Republic, the BLM document entitled “Cattle Trespass Impacts” directly states that Bundy’s cattle “impacts” solar development, more specifically the construction of “utility-scale solar power generation facilities” on “public lands.”

“Non-Governmental Organizations have expressed concern that the regional mitigation strategy for the Dry Lake Solar Energy Zone utilizes Gold Butte as the location for offsite mitigation for impacts from solar development, and that those restoration activities are not durable with the presence of trespass cattle,” the document states.

At Odds: Medical Marijuana and Private Prisons that Demand Maximum Capacity

With the surge of headlines debating the use of marijuana, the repeal of cannabis prohibition, and its medicinal qualities, one must wonder why some states are so hesitant in reforming their antiquated laws. If you’re still of the mindset that marijuana is a dangerous gateway drug that leads to acid trips and homicidal rampages, you really need to get with the times.

CNN’s chief medical correspondent, Dr. Sanjay Gupta, a highly respected neurosurgeon and frontrunner for Surgeon General of the United States, has recently, and very publicly stated that he was wrong about medical marijuana and is now a proponent of its use in medicine.

At the heart of this matter lies money, as with every political spectacle. On one hand, there is the potential tax money earned from the sale and regulation of marijuana, in a similar fashion as alcohol is currently handled. On the other hand, and often with much more political clout behind it (not to mention a small army of lobbyists), is the money earned in the private prison industry. These companies are traded on Wall Street based upon the number of prisoners inside, and push for strict drug laws that guarantee maximum profit....

On Monday, the Oklahoma State Senate passed a bill that would legalize gold and silver as legal tender, moving the legislation on to the House for consideration. The vote was 37-4.

If passed into law, Oklahoma could become the first state to recognize gold and silver as legal tender authorized for payments of debts and taxes.

Last month, the Arizona senate also passed a similar bill by a vote of 18-12. However, the governor has already vetoed a similar bill last year.

The United States Constitution states in Article I, Section 10, “No State shall…make any Thing but gold and silver Coin a Tender in Payment of Debts.” The Constitutional tender act is a big step towards that constitutional requirement which has been ignored for a long time in every state of the country. Such a tactic would achieve the desired goal of abolishing the Federal Reserve system by attacking it from the bottom up – pulling the rug out from under it by working to make its functions irrelevant at the State and local level....

In another devastating blow to freedom, the Supreme Court ruled Tuesday that police don’t need a warrant to search your property. As long as two occupants disagree about allowing officers to enter, and the resident who refuses access is then arrested, police may enter the residence.

“Instead of adhering to the warrant requirement,” Ginsburg wrote, “today’s decision tells the police they may dodge it, nevermind ample time to secure the approval of a neutral magistrate.” Tuesday’s ruling, she added, “shrinks to petite size our holding in Georgia v. Randolph.”

Hayden’s Note:

It should be noted that this decision does not allow police to enter homes at random. Instead, what it is saying – and reversing from a previous case noted above – is that even if you object to a search, if you are in custody or even being detained, police do not necessarily need a warrant to proceed with a search. This is an extremely slippery slope that will lead to further degradation of the 4th Amendment in the sense that search warrants require a very specific language, describing the person or place to be searched, as well as what police are searching for.

The Avenger (formerly Predator C), whose prototype flew its first flight in 2009, is operationally ready after a new round of tests completed last month, according to its maker, General Atomics. Based on the company’s more well-known MQ-9 Reaper drone, Avenger is designed to perform high-speed, long-endurance surveillance or strike missions, flying up to 500 mph at a maximum of 50,000 feet for as long as 18 hours.

Compared to its earlier prototype, Avenger’s fuselage has been increased by four feet to accommodate larger payloads and more fuel, allowing for extended missions. It can carry up to 3,500 pounds internally, and its 66-foot wingspan is capable of carrying weapons as large as a 2,000-pound Joint Direct Attack Munition (JDAM).

Switching from propeller-driven drones to jets will allow the CIA to continue its Pakistan strikes from a more distant base, if and when the U.S. is forced to withdraw troops entirely from neighboring Afghanistan.

I feel the need to comment on this issue because I am such a tech-geek. While I absolutely love our electronic frontier, and the constant pushing of boundaries and new ideas, I am also a staunch privacy and Constitutional advocate. As our technology stretches into what was once only science fiction, it is hard to develop apps or widgets that provide services without them also invading our private lives.

I am interested to hear what you have to think about not only this Android patent, but the rapid growth of personal technology. Do you see this particular tech as a benefit or a hindrance?

As eight states have introduced legislation to keep the NSA out of their borders, Tennessee’s newly introduced legislation packs the strongest punch yet.

The bill is known as the “Tennessee Fourth Amendment Protection Act”. State Senator Stacey Campfield (R) and State Representative Andy Holt (R) are the Senate and House sponsors. The bill was drafted and lobbied for by the Tenth Amendment Center, a national think-tank, which seeks to impede unconstitutional federal laws, regulations and entities on the state level.

“We have an out of control federal agency spying on pretty much everybody in the world. I don’t think the state of Tennessee should be helping the NSA violate the Constitution and the basic privacy rights of its citizens – and we don’t have to,” Campfield said. “This bill may not stop the NSA, but it will darn sure stop Tennessee from participating in unjustified and illegal activities.”

Campfield’s comments hold strong warrant. The NSA has been operating directly underneath the nose of many Tennesseans without them ever knowing. A long-standing secretive NSA computing facility calls Oak Ridge, Tennessee home. ...

The South Carolina state senate this week is considering a bill to virtually ban the use of drones without a warrant. It recently passed the state house unanimously, with a vote of 100-0.

Introduced in early 2013 by Reps. Hamilton (R), Delleney (R), Taylor (R), Putnam (R) and Loftis (R), House bill 3514 (H3514) would prohibit the operation of drones by an agency of the state unless it is “pursuant to a criminal warrant issued by a court of competent jurisdiction.”

“We’re really just updating our laws to keep up with some of the technology,” the bill’s primary sponsor, state Rep. Dan Hamilton, R-Taylors, told South Carolina Radio Network. ”The technology is changing rapidly. A lot of these companies that have sold them for use overseas are now marketing them domestically. I think, before things get out of hand, that we put a box around it and make they’re being used in the way they should be.”

FOX4 reports on a Cape Coral, Florida, woman who is being targeted by code enforcement officials because her home is “off grid.”

Robin Speronis, who outright owns her house, with property taxes up to date (do you truly own it if you continue paying “rent” in the form of property taxes?), has been served with an eviction notice after the local FOX affiliate ran a story about her living off the grid.

“A code enforcement officer came, knocked on the door, then posts a placard that says “Uninhabitable Property – Do Not Enter”, says Robin, as she reads the sign.

A local attorney has picked up the case, pro bono.
